Terms
Terms of Service
Effective October 18, 2026
On this page
These terms are an agreement between you and PaintBrush (paintbrushdb.com) ("PaintBrush", "we", "us"), based in Gilbertsville, PA, United States. They cover the PaintBrush desktop app, PaintBrush On the Go (the phone app), the website at paintbrushdb.com, shared-hand links, cloud backup, and the servers behind them (together, "PaintBrush"). Our Privacy Policy and Refund Policy are part of these terms.
By installing or using PaintBrush you accept these terms. If you don't accept them, don't use PaintBrush.
1. Who can use PaintBrush
- You must be 18 or older and able to enter a contract.
- PaintBrush is study software. It offers no gambling and handles no wagers. Whether playing poker, or using poker software, is legal where you are is your responsibility.
2. What PaintBrush is
PaintBrush is a poker database that runs on your PC. It reads the hand histories your poker clients write, and helps you review your own play after the session. Its luck figures, solver results and Claude's answers are estimates. Nothing in PaintBrush is gambling, financial or professional advice, and we promise no results.
3. Plans and prices
| Plan | Price |
|---|---|
| Free | $0, with no time limit |
| Pro | $50 a month |
| Artist | $100 a month |
- What each plan includes is on the plans page at paintbrushdb.com. Features change as PaintBrush develops. We won't remove a plan's main features during a period you have already paid for.
- Features marked "coming soon", "beta" or "preview" may change, stop, or never ship.
- Lifetime, when it comes. A lifetime option isn't offered yet. When it is, everything you have paid for Pro or Artist before then is credited toward it. Lifetime owners top up Claude credits only as they use them, and may add cloud storage for a small optional fee. We will honour this when lifetime launches, on the terms stated when it is offered.
4. Paying
- Payments are processed by our payment provider, the merchant of record. It sells you the licence, charges you, collects sales tax or VAT, and issues receipts and refunds. Its own buyer terms and privacy policy apply to the checkout. We never see your card details.
- Subscriptions renew automatically at the end of each month until you cancel. Cancel any time from the link in your receipt email. Cancelling stops the next renewal, and your plan keeps working until the end of the period you paid for.
- Price changes apply from your next renewal. We'll tell you at least 30 days before.
- If you dispute a charge with your bank, we may suspend the licence until the dispute is settled.
- Refunds follow the Refund Policy.
5. Your licence
- The grant. We give you a personal, non-exclusive, non-transferable licence to use PaintBrush for your own study, on the terms of your plan. We may end it as section 15 says.
- Free needs no licence key. If you turn on phone sync, the app gets a free licence for that computer by itself: no key, no email. Our relay needs it to keep accounts traceable and stop abuse.
- One player per licence. A paid licence is for one person's own play, on all of that person's computers. PaintBrush checks this by comparing salted one-way hashes of the screen names in each computer's database (Privacy Policy explains). A computer whose hands belong to another player is refused.
- Computers. Free: any number. Pro: 2 at a time. Artist: 3 at a time. Phones don't count. To free a seat, open the PaintBrush menu, then Licence, then Deactivate. A new computer with no hands yet gets 3 days to show it belongs to the same player.
- Offline use. A paid plan works offline until the end of the period you have paid for, plus a 3-day grace. Claude, phone sync, cloud backup and downloading a plan's features need the internet.
- When a plan ends (cancelled, lapsed, refunded, or turned off under section 15), the app runs as Free. Your hands, notes, tags, sessions, bought themes and settings stay on your PC. The locked features come back if you subscribe again.
- Paid features download to your PC when a paid licence is activated, and only work on that computer under that licence.
6. Acceptable use
PaintBrush is for studying your own play away from the tables.
You agree to follow the rules of every poker site, app and card room you play on. Those rules bind you, and they differ. Some ban trackers or any third-party software from running while their client is open. Some ban sharing hand histories. It's your job to know and follow them.
You must not:
- use PaintBrush, or anything it shows, to get help during a hand or while a poker client is open where the site forbids it;
- import hand histories that aren't yours. Only hands you were dealt into, from files your poker client or site gave you, or your own PokerTracker 4 archive. No bought, mined, shared or scraped hands;
- share, sell, rent or lend a licence key, or let more than one player use a licence;
- reverse engineer, decompile, patch or crack PaintBrush, its licence checks or its paid features, or copy them out, except where the law allows this despite these terms. The open-source parts in section 9 are governed by their own licences instead;
- get around plan limits, seat limits, rate limits or Claude limits;
- attack, overload or probe our servers, or use the phone relay, cloud backup or share site to store or send anything other than PaintBrush data;
- put anything illegal, harmful, or someone else's private information into feedback, theme requests or shared hands;
- use Claude through PaintBrush in breach of Anthropic's Usage Policy.
Safeguards, not guarantees. While PaintBrush sees a poker client it recognises running on your PC, it hides features that inform play, such as solver output and preflop charts. On the phone, Claude's answers, strategy cards and the equity calculator close while a live session is running. These safeguards cover a limited list of clients and features. They don't make any use compliant, and they don't move your responsibility to us.
7. Claude, the AI features
- Pro and Artist include Claude, an AI model made by Anthropic. Claude can be wrong. Check what matters before you rely on it.
- When you ask Claude something, your question and the data Claude reads to answer it are sent to Anthropic. The Privacy Policy says exactly what.
- Allowance. Each paid plan includes a monthly Claude allowance, as stated on the plans page when you subscribe. Fair-use limits apply, including a daily cap. Credit packs, priced in the app when you buy them, top it up. Unused allowance doesn't carry over to the next month. Credits have no cash value and can't be transferred.
- Your own Claude API key. On Pro and Artist you can enter your own Anthropic key instead. Your questions then go straight from your PC to Anthropic, under your own agreement with Anthropic, and Anthropic bills you.
8. The phone app (PaintBrush On the Go)
- It logs live sessions and syncs them with PaintBrush on your PC, end-to-end encrypted. Your PC holds the master copy.
- Android: the app is downloaded from our website, outside Google Play. Its Check for updates button fetches new versions from our server. Install updates only from the app or from our website. iPhone: add the web app to your Home Screen from our website.
- Public builds contain no testing switches. Test builds are for invited testers only. Don't share them.
- Card rooms ban strategy aids at the table. Log between hands, not during one. The equity calculator is a study tool.
9. Solvers and other software
- PioSOLVER. Artist's autosolve can run your own copy of PioSOLVER. You need your own PioSOLVER licence, bought from its maker, and you must follow its terms. We don't sell, supply or support PioSOLVER. The same goes for any other solver you point PaintBrush to.
- The free engine. Artist includes postflop-solver by Wataru Inariba, licensed under the GNU Affero General Public License v3.0 or later (AGPL), through PaintBrush's
pfs_engineprogram, also AGPL. Their source code ships in the app folder (resources/server/engines), and we'll send it to anyone who asks at owner@paintbrushdb.com. The original is at https://github.com/b-inary/postflop-solver. The AGPL, not these terms, governs those components, and nothing here limits your rights under it. - Other open-source parts keep their own licences. We'll send the list of them to anyone who asks.
- No affiliation. PaintBrush isn't affiliated with, endorsed by or partnered with any poker site, solver maker, training site or stats service. Their names are their owners' trademarks. We use them only to say what PaintBrush works with.
10. Themes
- Every theme shows in the library. A theme your plan doesn't include can be bought: $10 on Free, $5 on Pro. Artist includes them all. A bought theme stays yours on any plan.
- Custom themes (Artist). You can ask for a theme made for you. Choose Private and it is yours alone. Choose Public and it joins the library for every player, your description may be shown with it, and you'll see how many players wear it. Don't describe anything you have no right to use, such as another brand's logo or a real person's likeness. We may decline a request, and we don't promise a delivery date. We own the finished theme, and we never offer a Private theme to anyone else.
- Theme pictures may change if their licensing requires it.
11. Shared hands
- Share makes a link anyone who has it can open. The hand is anonymised: you are "Hero", everyone else "Villain", and opponents' cards appear only where they were shown. It includes the site, stakes, actions, board, results in big blinds, your theme and, on Artist, the solve if you include it.
- Links aren't listed anywhere, and search engines are asked to stay out, but anyone you give a link to can pass it on.
- Take a link down any time in the app (Share, then Take the link down). We keep a hand until you do.
- Whether your poker site allows sharing hands is for you to check. We may remove a shared hand that breaks these terms.
12. Cloud backup (Artist)
- Your database is encrypted on your PC with a key sealed under your passphrase and your recovery key. We store it and can't read it.
- If you lose both your passphrase and your recovery key, nobody, including us, can open the copy. It can only be deleted and set up again.
- Open the web version only on a computer you trust.
- Each account gets 5 GB. We keep the last 10 versions and every version from the last 7 days.
- If your Artist plan ends, backups stop. You can still restore and delete the copy for 90 days, after which we delete it, with notice.
- Cloud backup is an extra copy, not a guarantee. Keep your own backups too.
13. Your data and your feedback
- Your hands, notes and sessions are yours. We only use them as needed to run what you ask for, such as storing your encrypted sync data or hosting a hand you share.
- If you send us feedback or ideas, we may use them without owing you anything.
14. Our property
PaintBrush's software, design, themes and name belong to us or our licensors, apart from the open-source parts in section 9. These terms give you no other rights in them.
15. Suspension and ending
- You can stop using PaintBrush at any time. To cancel a subscription, use the link in your receipt email. To delete your data, see the Contact page.
- We may suspend or end a licence, or access to our servers, for a serious or repeated breach of these terms, fraud, or a legal requirement. We'll say why where we can. If we end a paid licence without cause, we'll refund the unused part of the period you paid for. Either way, your data on your PC stays, and the app runs as Free.
- We may shut down an online service (the relay, cloud backup or the share site) with at least 60 days' notice, and time to restore or delete your data.
16. Changes
We update PaintBrush often, and features can change. We may also change these terms. We'll post the new version here with a new effective date, and tell you at least 30 days ahead of a material change, by email or in the app. If you keep using PaintBrush after a change takes effect, you accept it.
17. Disclaimers
PaintBrush is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, including merchantability, fitness for a purpose and non-infringement. We don't promise that PaintBrush is error-free, that its estimates are accurate, or that any poker site will accept its use. We aren't responsible for anything a poker site, app or card room does to your account.
18. Limits on our liability
To the extent the law allows:
- we aren't liable for indirect, incidental, special or consequential losses, lost profits or winnings, lost data, or poker losses;
- our total liability for any claim is limited to the greater of what you paid us in the 12 months before it, or $50.
Some places don't allow these limits. Where they don't, they apply only as far as allowed, and your rights as a consumer stay.
19. Indemnity
If someone makes a claim against us because you broke these terms or a poker site's rules, you'll cover our reasonable costs of it, to the extent the law allows.
20. Governing law and disputes
These terms are governed by the laws of the Commonwealth of Pennsylvania, United States. Disputes go to the state or federal courts serving Montgomery County, Pennsylvania, not to arbitration. Before any claim, write to us and give us 30 days to put it right. If you are a consumer, you keep the protections of the law where you live.
21. General
These terms, the Privacy Policy and the Refund Policy are the whole agreement between us about PaintBrush. If part of them can't be enforced, the rest stands. Not enforcing a term isn't a waiver. You can't transfer these terms; we may transfer them to whoever takes over PaintBrush. If a translation differs, the English version applies.
